Where an arbitration clause exists, before the acceptance of office by the sole arbitrator or the constitution of the arbitral tribunal an application for interim relief is to be made to the ordinary court having jurisdiction, pursuant to art. 818, final co., cod. proc. civ.
The ordinary court retains jurisdiction over interim relief where neither the appointment of the arbitrator nor the filing of an application to obtain it is shown, so as to avoid gaps in the availability of urgent protection.
