Legal principle

An award rendered in arbitration and declared enforceable under art. 825 cod. proc. civ. shares the nature of a judicial enforcement title and may be construed in the light of the evidence gathered in the arbitral proceedings; the expert's prescriptions incorporated by reference in the operative part of the award form part of its binding content, so that the enforcement court may not prescribe methods of enforcement inconsistent with them.
