The principle of autonomy of the arbitration clause from the contract to which it pertains, enshrined in Article 808(2) of the Code of Civil Procedure, entails that the mutual dissolution of the contract does not extinguish the arbitration clause, unless the parties expressly provide otherwise.
An arbitration clause, in the absence of an express contrary intention, must be interpreted as referring to arbitration all disputes having their causa petendi in the contract to which the clause is annexed, in application of the favor arbitrati principle.
