Where a party has manifestly indicated its intention not to comply with the arbitration agreement by refusing to appoint its arbitrator, the president of the court makes the appointment pursuant to art. 810 co. 2 cod. proc. civ., upon application by the other party, without any need to assess the merits of the reasons for the refusal.
