Legal Principle

Article 813-ter of the Code of Civil Procedure, which prohibits the commencement of court proceedings where arbitral proceedings between the same parties and having the same subject matter are pending, also applies to contractual arbitration (arbitrato irrituale), with the consequence that court proceedings are inadmissible where the arbitral proceedings are still pending and the arbitrator has neither lapsed nor resigned from the appointment.
