Court of Ravenna, 26 January 2026, No. 46

An arbitration clause that confers on an arbitral tribunal jurisdiction over disputes arising from the application of a set of regulations does not apply to an action for specific performance pursuant to Article 2932 of the Civil Code seeking a judgment in lieu of consent to the conclusion of a contract not governed by those regulations, there being no nexus of dependency between the dispute and the content of the regulations to which the clause refers.
