Legal Principle
The presence of a contractual clause requiring the prior completion of a conciliation and arbitration procedure before the commencement of any court proceedings may affect the enforceability of the claim in summary proceedings for a payment order pursuant to Article 640 of the Code of Civil Procedure, requiring the applicant to set out specifically the compatibility of the application for a payment order with that arbitration clause.
