Upon application by the members of the arbitral tribunal, the court assesses, under art. 814, co. 2, cod. proc. civ., the fees due for the arbitral proceedings concluded by an award, after examining the record of the proceedings, the award and the tribunal’s order assessing the fees.
The assessment is appropriate where it takes into account the value and complexity of the dispute, the period over which the arbitral activity extended, the number of hearings and deliberative sessions, as well as the documentation examined.
Payment of the fees so assessed is imposed on the parties to the arbitral proceedings jointly and severally, in accordance with the undertaking given by them.
