A procedural decision declining jurisdiction in favour of an arbitrator, issued in proceedings for opposition to an order for payment, does not affect the availability of the ordinary revocatory action for the protection of the same credit, given that such decision does not contain any determination on the merits of the claim and does not preclude the qualification of the credit as “contingent” or “disputed” for the purposes of standing to bring proceedings under Article 2901 of the Civil Code.
