An arbitration clause inserted in a contract between a professional and a consumer is null and void for being unfair when the professional fails to provide proof of having conducted serious, effective and specific individual negotiations with the consumer regarding the derogation from the jurisdiction of judicial authority, the mere double signature of the clause pursuant to Article 1341, paragraph 2 of the Civil Code being insufficient.
