Arts. 669 octies and 669 nonies cod. proc. civ. apply also where the proceedings on the merits are, by virtue of an arbitration clause contained in the contract, referred to arbitration, as appears from art. 669 nonies, co. 5, cod. proc. civ.
A party bound to commence the proceedings on the merits, including in the form of arbitration, who fails to show that it did so within the mandatory time limit running from notification of the interim measure, is subject to a declaration that the measure granted has ceased to be effective.
