Court of Pesaro, 7 October 2025, No. 523

An arbitration clause contained in a contract does not automatically extend to subsequent contractual relationships, even when connected to the first, where the latter have autonomous and independent existence, and the acts alleged to be supplementary to the original relationship are not signed by both contracting parties.
The complete performance of obligations arising from the contract containing the arbitration clause results in the exhaustion of the contractual relationship and confirms the autonomy of subsequent contractual relationships, with the consequent non-transferability of the arbitration clause.
