The failure to propose an application for verification by one who produces a disavowed document containing an arbitration clause, like subsequent waiver thereof, depriving the disavowed document of any probative inference, precludes the judge from evaluating it for the purpose of forming his conviction, rendering the document irrelevant and unusable not only against the party who disavows it, but also against the party who produced it, with consequent unusability of any arbitration or derogatory clause contained therein.
