An arbitration clause contained in the extrajudicial enforceable instrument on which a writ of enforcement (precetto) is based may be raised by way of opposition to the writ, with the result that, where the dispute is referred to arbitration, the writ must be declared null and void, similarly to what occurs in opposition proceedings against a payment order in the presence of an arbitration clause.
