Where the applicable arbitration rules confer upon the arbitral tribunal the power to grant interim measures, the ordinary court lacks interim jurisdiction after the constitution of the arbitral tribunal, since the arbitral interim jurisdiction concurs with judicial interim jurisdiction only on a diachronic basis, under art. 818, para. 2, of the Code of Civil Procedure, with judicial interim jurisdiction being limited to the period preceding the acceptance of the sole arbitrator or the constitution of the tribunal.
