Court of Nola, decree of 8 September 2026 (R.G. 00003576/2026)

In application of the principle in dubio pro arbitration, the arbitration is to be characterised as arbitration proper where the documents do not disclose a specific written declaration by the parties intended to confer upon the arbitrators’ determination the force of a contract.
Arbitral proceedings proper conclude with a decision destined to acquire the force of a judgment, and not of a contract, and as such incapable of constituting a title for the issue of an order for payment (decreto ingiuntivo).
