Court of Nola, 2 February 2026, No. 394

An arbitration clause contained in the rules of an entity which refers to arbitrators disputes relating to those rules and disputes arising between members and the entity or its organs is not applicable to disputes arising from a contract entered into between one of the parties and a third party, even where such contract contains a reference to the rules themselves.
An arbitration clause contained in a contract does not extend to disputes arising from a different contract which refers to it but which involves different parties, given that the arbitration clause binds exclusively the parties to the contract in which it is contained.
