Where a company must be a defendant or must be joined as a necessary party in arbitral proceedings concerning the challenge of shareholders’ meeting resolutions appointing its governing body vested with legal representation, the conditions are met for the appointment of a special curator (curatore speciale) pursuant to Articles 78 et seq. of the Code of Civil Procedure who may represent and assist the company in the said arbitral proceedings.
