The proceedings for the appointment of an expert under art. 2473, para. 3, of the Civil Code, aimed at determining the value of the withdrawing member's share, are of a non-contentious nature and are not stayed by the pendency of arbitral proceedings concerning the validity of the withdrawal itself.
