An arbitration clause contained in a contract is not enforceable against the assignee of the credit who has not assumed the position of the assignor under the main contract, since the assignment of the credit does not entail the automatic transfer of the arbitration agreement, with the consequent lack of standing of the assignee to participate in the arbitral proceedings as a third party in relation to the arbitration agreement.
