Arbitration clauses contained in contracts entered into by consumers for purposes unrelated to business or professional activities are presumed to be unfair under Article 33, letter t), of the Consumer Code, with consequent nullity for breach of Article 36 of the same Code, unless individual negotiation characterised by the requirements of seriousness, effectiveness and individuality is proven according to the parameters set out in Article 34, paragraph 4, of the Consumer Code.
