The ordinary judicial authority lacks jurisdiction when the dispute falls within the scope of application of arbitration clauses contained in the articles of association of an entity, with consequent inadmissibility of ordinary proceedings. Grievances which, according to the statutory provisions of the entity, must be the object of arbitration cannot be submitted to the cognizance of the ordinary court, which must declare its own lack of jurisdiction.
