In case of clause compromise inserted in a contract contract contract, devolutive to the referees of the disputes inherent the interpretation or the application of the contract, must be considered that the potestas iudicandi of the referees it is actions attractive the assessment of the indant o contractual, is the consequent compensation of the damage, is finally the liability aquilian ex art. 1669 code civ. this in application of 'Art. 808-Quater Cod. Proc. civ., which is Norma aimed to the integration of the competence referee, as demonstrated by all the reform of 2006.
