The presence in the contract of an arbitration clause conferring upon arbitrators the determination of disputes arising from the agreement constitutes grounds precluding the grant of an application for an order for payment filed before the ordinary judicial authority, since jurisdiction to hear the dispute lies with the arbitral tribunal conventionally designated by the parties.
