The presence of an arbitration clause in the contract does not preclude the bringing of an application for an order for payment before the ordinary court for a claim arising from the same contract. However, where the respondent raises the operation of the arbitration clause in opposing the order, the court hearing the opposition must revoke the order for payment and declare the application for the order inadmissible, referring the parties to arbitration.
