The presence of an arbitration clause precludes recourse to the preventive technical consultation for the settlement of disputes under art. 696 bis of the Code of Civil Procedure, which cannot be recognised as having an interim nature either in terms of urgency or of prima facie case, with the consequence that art. 669 quinquies of the Code of Civil Procedure does not apply to that procedural instrument.
