An arbitration clause which refers to an arbitral tribunal disputes relating to the contract, with express exclusion of those concerning rent and sums agreed between the parties, determines the jurisdiction of the ordinary court for the application for a payment order relating to unpaid rent, whilst it establishes arbitral jurisdiction for the counterclaim for damages brought by the opposing party, with consequent declaration of lack of jurisdiction of the ordinary court limited to the latter claim.
