The court retains jurisdiction over applications for interim relief even where the proceedings on the merits are referred to arbitral jurisdiction, save where the parties have expressly conferred on the arbitrators the power to grant interim relief pursuant to art. 818 cod. proc. civ.
The existence of an arbitration agreement does not affect the assessment of the fumus boni iuris of the claim asserted in interim proceedings.
