The Board of Arbiters (Collegio dei Probiviri) provided for by the statute and internal regulations of an unincorporated association does not constitute an arbitral body within the meaning of articles 806 et seq. of the code of civil procedure where the requirement of independence is lacking, being composed solely of internal members of the association, with the result that the relevant provision does not amount to an arbitration clause capable of derogating from the jurisdiction of the courts, but merely constitutes a procedural framework for the formation of the organisation's will.
