The preventive technical consultation for conciliation purposes under art. 696-bis of the Code of Civil Procedure does not have a cautionary nature, but rather primarily a conciliatory and possibly anticipatory evidentiary nature, regardless of the requirements of fumus boni iuris and periculum in mora, with the consequence that art. 669-quinquies of the Code of Civil Procedure, which allows the submission of interim applications to the ordinary court in the presence of an arbitration clause, does not apply to it.
