Contractual arbitration (arbitrato irrituale) constitutes a contractual mechanism for dispute resolution. The final award has the nature of a contract and does not acquire the effects provided for by Article 824-bis of the Civil Procedure Code, which are specific to jurisdictional judgments.
Professional activity carried out within contractual arbitration proceedings is characterized as extrajudicial activity. Consequently, disputes relating to fees owed for such activity are not subject to the special summary procedure under Article 14 of Legislative Decree 150/2011.
