A stay of the enforceability of a challenged award falls within the jurisdiction of the Court of Appeal seized of the action for annulment under art. 830, co. 4, cod. proc. civ., so that stay proceedings in an opposition to enforcement cannot be used to re-examine the fumus of the grounds for annulment of the award.
Where enforcement is based on an award rendered in arbitration and declared enforceable, an opposition to enforcement does not allow facts predating the formation of the title or which could have been raised in the arbitration to be reopened, only subsequent facts extinguishing or modifying the right established in the award being relevant.
