The existence of an arbitration clause does not exclude the jurisdiction of ordinary courts to issue a payment order (decreto ingiuntivo – a summary procedure for undisputed debts), given that arbitral procedure does not contemplate the issue of ex parte orders. However, the ordinary court must, in case of subsequent opposition based on the existence of an arbitration clause, declare the nullity of the contested order and simultaneously refer the dispute to arbitral determination.
