A party raising the objection of arbitral jurisdiction in place of that of the ordinary court bears the burden of proving the existence and content of the arbitration agreement with reference to the specific relationship relied upon in the proceedings.
An arbitration clause contained in a contract does not operate in respect of claims concerning distinct and autonomous legal relationships subsequently entered into between the same parties, in relation to which no ruling is sought on the validity, effectiveness, performance or termination of the contract containing it.
