An arbitration clause that refers to arbitration “all disputes” relating to a contract encompasses claims for payment arising from the performance of that contract, absent an express provision to the contrary, since the right to payment accruing in the course of performance constitutes an element provided for and regulated by the main contract.
The interpretation of an arbitration clause must be conducted in accordance with literal, systematic and purposive criteria, giving due weight to the parties’ intention of securing, through the reservation of arbitral jurisdiction, the advantages in terms of speed, confidentiality and technical expertise characteristic of arbitral proceedings.
