Pursuant to art. 818 of the Code of Civil Procedure, as amended by legislative decree No. 149/2022, the parties may confer upon the arbitrators the power to grant interim measures by way of the arbitration agreement or by a written instrument prior to the commencement of the arbitration proceedings. However, before the acceptance of the sole arbitrator or the constitution of the arbitral tribunal, the application for interim measures is to be filed with the competent court pursuant to art. 669 quinquies of the Code of Civil Procedure.
