Arbitration clauses contained in corporate articles of association are valid and effective for the devolution to arbitration of disputes concerning available rights arising from the corporate relationship, from the interpretation or application of the articles themselves.
The finding of the lack of jurisdiction of the ordinary court due to the presence of an arbitration agreement entails the declaration of nullity of the injunctive decree issued in violation of arbitral jurisdiction.
