An arbitration clause contained in the articles of association of a consortium, which submits disputes relating to consortium relationships to arbitrators, cannot be invoked against a third party who is not a member of the consortium and who brings or defends proceedings against the consortium in relation to contractual relationships that are independent of the associative bond, such as service contracts, given that the subjective efficacy of the statutory arbitration agreement is limited solely to those who hold the status of members or consortium participants.
