Court of Bologna, 25 September 2025, No. 2372

The arbitration clause contained in a general contract between multiple parties extends to all disputes relating to obligations arising from the same contract, even when they arise between parties who have subsequently entered into specific agreements that merely regulate particular aspects of the relationship without containing a different clause for dispute resolution.
The declaration of lack of jurisdiction by the ordinary court due to the existence of an arbitration agreement automatically entails the nullity of the payment order issued by the same incompetent court, requiring the court hearing the opposition to rule by judgment having dual content regarding both lack of jurisdiction and nullification of the payment order.
