The special procedure for the assessment of arbitrators' fees provided for by Article 814 of the Code of Civil Procedure in respect of arbitration is not applicable, even by analogy, to contractual arbitration (arbitrato irrituale), since the fee owed to contractual arbitrators does not constitute an expense of the proceedings but a debt arising from the mandate, for the compulsory performance of which ordinary proceedings on the merits may be brought.
