Arbitrators who have rendered their services are entitled to their fees even if the award is subsequently declared null following a challenge.
An action for liability against arbitrators under art. 813 ter of the Code of Civil Procedure may be brought, where an award has been rendered, only after the challenge has been upheld by a judgment that has become final and on the grounds on which the challenge was upheld. The mere pendency of challenge proceedings is irrelevant for the purposes of reducing or eliminating the fee.
