The commencement of arbitral proceedings interrupts the running of the limitation period in respect of the right asserted in the arbitration, as does an extra-judicial demand addressed to the other party.
The findings of the evidentiary stage conducted in the arbitral proceedings may, where not specifically disputed in subsequent court proceedings, form the basis for a determination of breach.
