In granting exequatur pursuant to Article 825 of the Code of Civil Procedure, the court’s review is limited to verifying the formal regularity of the award, concerning on the one hand the verification of the requirements necessary for enforceability (application by the party, deposit of the award in the prescribed forms, production of the arbitration agreement) and on the other hand the verification of the formal prerequisites of the award itself (institutional nature of the arbitration and signature of the arbitrators).
The procedure for the declaration of enforceability of an arbitral award pursuant to Article 825 of the Code of Civil Procedure does not require the establishment of adversarial proceedings, as these are only provided for in a potential and deferred phase.
