Legal Principle

An arbitration clause contained in a contract drafted unilaterally is ineffective where it has not been specifically referred to, nor supported by an autonomous signature or separate written approval pursuant to arts. 1341 and 1342 of the Civil Code. A generic declaration of acceptance of all contractual clauses does not satisfy the requirement of specific written approval of the arbitration clause.
