Arbitration case law

sentenza

Court of Appeal of Salerno, judgment of 11 September 2026, No. 1026

Corte di Appello of Salerno

Legal principle

Clauses derogating from competence, such as arbitration clauses, are to be construed strictly and may not be extended beyond what is expressly provided.
A clause in the constitution referring to an arbitral tribunal disputes arising between the consortium members does not permit disputes between the consortium and the individual members to be brought within the arbitral competence.
