Legal Principle

A letter of request originating from a foreign arbitral tribunal is capable of enforcement in the domestic legal system pursuant to Article 69 of Law No. 218/1995, provided that its execution does not conflict with rules of public policy, with consequent transmission of the file to the President of the territorially competent Court for the appointment of the investigating judge responsible for taking the requested means of evidence.
