The supervening restrictive regime concerning arbitration in public contracts has no retroactive effect and does not affect the validity of arbitration clauses contained in contracts already concluded. A finding that a person is extraneous to the contractual relationship renders the arbitration clauses contained therein ineffective as against him, with the consequent non-actionability or inadmissibility of the arbitral claims brought against him.
