Court of Appeal of Rome, 18 December 2025, No. 7729

An arbitral award constitutes a valid enforcement title capable of founding forced execution against assets settled in a family patrimony fund (fondo patrimoniale), without the arbitral nature of the title affecting the rules governing the enforceability of such assets, which remains governed by Article 170 of the Civil Code and the relevant criteria linking the ascertained debt to the needs of the family.
