Court of Appeal of Rome, 12 October 2025, No. 5780

The arbitration clause contained in a consortium statute that confers jurisdiction to the arbitral tribunal for all disputes relating to the application, performance and interpretation of the consortium contract maintains its effectiveness even when an exception is provided for the issuance of a payment order, limiting the jurisdiction of the ordinary court to the summary proceedings for payment orders and related procedural exceptions only, excluding claims for damages relating to the performance of the contractual relationship.
