The presence of an arbitration clause in a contractual agreement does not preclude the ordinary court from having jurisdiction over matters relating to the nature and legal characteristics of a claim, such as the determination of a privilege, where such matters are deemed distinct and autonomous from disputes referred to arbitral jurisdiction concerning the existence, amount and accessories of the claim itself.
